Interpretation

Terms with capitalized initial letters have specific meanings as defined below. These definitions apply regardless of whether they appear in singular or plural form.

Definitions

For the purposes of these Terms of Use:

• Company (referred to as "FileMorph", "we", "us", or "our") refers to the developer and provider of the FileMorph software.
• Software refers to the FileMorph PDF converter application for Windows.
• Device means any computer on which you install and use the Software.
• Service refers to the Software and any associated services provided by FileMorph.
• Terms of Use (also referred to as "Terms") mean these Terms of Use that form the entire agreement between you and the Company regarding the use of the Software.
• You means the individual or entity accessing or using the Software.

These Terms of Use govern the download, installation, and use of the FileMorph Software and constitute the agreement between You and the Company. Your access to and use of the Software is conditioned on Your acceptance of and compliance with these Terms.

By downloading, installing, or using the Software, You agree to be bound by these Terms. If You disagree with any part of these Terms, You may not use the Software.

You represent that You are over the age of 18. The Company does not permit those under 18 to use the Software without parental consent.

Your use of the Software is also conditioned on Your acceptance of and compliance with our Privacy Policy. Please read our Privacy Policy carefully before using our Software.

FileMorph grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Software for your personal or internal business purposes on devices owned or controlled by you in accordance with these Terms.

You may not:

• Modify, reverse engineer, decompile, or disassemble the Software
• Rent, lease, lend, sell, redistribute, or sublicense the Software
• Copy, duplicate, or reproduce the Software except as expressly permitted
• Use the Software for any illegal purpose or in violation of any local laws
• Use the Software to infringe upon intellectual property rights of others
• Remove or alter any proprietary notices on the Software

The Software and its original content, features, and functionality are and will remain the exclusive property of FileMorph and its licensors. The Software is protected by copyright, trademark, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of FileMorph.

FileMorph may from time to time provide enhancements, updates, or new versions of the Software. These Terms will govern any updates provided by FileMorph, unless an update is accompanied by a separate license, in which case the terms of that license will govern.

The Software may display, include, or make available third-party content or services. You acknowledge and agree that FileMorph is not responsible for any third-party content or services.

Any dealings you have with third parties while using the Software are between you and the third party. FileMorph shall not be responsible or liable for any loss or damage incurred as a result of such dealings.

To the maximum extent permitted by applicable law, in no event shall FileMorph be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, that result from the use of, or inability to use, the Software.

In no event will FileMorph's total liability to you for all damages exceed the amount you paid for the Software, if any. The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

The Software is provided to you "AS IS" and "AS AVAILABLE" without warranty of any kind. To the maximum extent permitted by applicable law, FileMorph disclaims all warranties, whether express, implied, statutory or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

FileMorph makes no warranty that the Software will meet your requirements, be error-free, or operate without interruption. Any material downloaded or otherwise obtained through the use of the Software is accessed at your own risk.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company operates, without regard to its conflict of law provisions.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion.

By continuing to use the Software after revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Software.

We may terminate or suspend your access to the Software immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination, your right to use the Software will immediately cease. If you wish to terminate your agreement with us, you may simply discontinue using the Software.
